Terms of Service

These Terms of Service (“ToS”) constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and RBT Software LLC (“the Company,” “we,” “us” or “our”), concerning your access to and use of the Root Beer Tag website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the “Site” or “Website”).

You agree that by accessing the Site, you have read, understood, and agree to be bound by all of these ToS. If you do not agree with all of these ToS, then you are expressly prohibited from using the Site and you must discontinue use immediately.

User Definitions

• Root Beer Tag Site Owner
  • Any Site user that has subscribed to Root Beer Tag (or is beta testing for us). Site owners are provided their own unique instance of a Root Beer Tag Site. They have the ability to upload images to their Site and assign levels of user and/or visitor access to that Site.
• Root Beer Tag Authenticated User
  • Any user configured on a unique Root Beer Tag Site that has been granted elevated access by the Site’s owner. This access is specific to the grantor’s Site and no others.
• Root Beer Tag Visitor
  • Any unauthenticated user visiting a Root Beer Tag Site.

Additional ToS For Site Owners Only

• Ownership of and Access to Uploaded Content
  • You recognize and agree that by uploading any images to your Root Beer Tag site, you confirm that you own all the relevant rights or received the appropriate license to upload/transfer/send the content.
  • You are responsible for controlling the access to your Root Beer Tag site, including who has access (with appropriate user levels) and what they have access to (thumbnails and full-sized images).
  • RBT Software LLC is not responsible for unauthorized access to users’ Root Beer Tag sites (and contained images) due to incorrect site settings set by site owners.

Intellectual Property

• All content published and made available on our Site is the property of RBT Software LLC and the Site’s creators. This includes, but is not limited to images, texts, logos, documents, downloadable files, and anything that contributes to the composition of our Site. However, images cataloged on a given Root Beer Tag Site are the property of individual Site owners.

Prohibited Activities

• You may not access or use our Site for any purpose other than that for which we make our Site available. Our Site may not be used in connection with any commercial endeavours except those that we specifically endorse or approve. As a user of our Site, you agree not to:
  • lease, sell, copy, sublicense, transfer, or assign any information, intellectual property, goods, or services provided on our Site
  • use our Site for any illegal purpose
  • gain unauthorized access to the Company’s data or the data of other users
  • alter, modify, adapt, reverse engineer, decompile, disassemble, or hack the Company’s intellectual property
  • alter or modify another website to falsely imply that it is associated with the Company’s Website,
  • use or export the Company’s information, products, or services in violation of U.S. export laws and regulations
  • violate anyone else’s legal rights (for example, privacy rights) or any laws (for example, copyright laws) in the user’s jurisdiction
  • use our Website or the Company’s services to transmit content that could be deemed unlawful, threatening, harassing, racist, abusive, libelous, pornographic, vulgar, defamatory, obscene, indecent, or otherwise inappropriate, including any messages constituting or encouraging criminal conduct
  • breach, or attempt to breach our Website’s security systems
  • enabling third parties to violate the Terms of Use, and
  • (if legally required) failing to ensure that all end users of our Site are at least 18 years of age or older

Indemnification and Disclaimer of Liability

• Except where prohibited by law, by using our Site you indemnify and hold us harmless and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities, and expenses including legal fees arising our of your use of the Site or your violation of these ToS.
• RBT Software LLC and our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities, and expenses including legal fees from the use of our Site.

Changes

• These ToS may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate our Site and the way we expect users to behave on our Site. We will notify registered users by e-mail of changes to these ToS or post a notice on our Site.

Severability

• If at any time any of the provisions set forth in these ToS are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these ToS. All other provisions will not be affected by the removal and the rest of these ToS will still be considered valid.

Applicable Law

• These ToS are governed by the laws of the State of Wisconsin.
